​1. Refund of Fees
You may withdraw from the course and request for full refund of the Fees at any time provided that: (i) you have not attended any of the Online Course/Physical Course provided; and (ii) you have yet to sign in and/or register/or access and/or log in to the Course Materials.
2. Liability

No part of the provision of the Services shall be deemed to be, nor is it intended to be, nor should it be taken to be, the provision of “investment advice” under the Schedule 2 of the Capital Markets and Services Act 2007.

TX is not licensed by the Security Commission Malaysia for providing investment advice and all the provision, Confidential Information and Course Materials of the Services is only for illustration and educational purposes.

Although TX aims to provide the Services to the highest standards of the industry, neither it, nor its trainers/speakers accept any liability for (i) any inaccuracy or misleading information provided in the course or Course Materials and any reliance by you on any such information, (ii) any loss or corruption of data, (iii) any loss of profit, revenue or goodwill, or (iv) any indirect, special or consequential loss arising from any breach of the terms of this Agreement.

Except to the extent that they are expressly set out in these terms and conditions, no conditions, warranties or other terms shall apply to the Services.

Notwithstanding anything to the contrary, TX's total liability arising from or in connection with these terms and conditions and in relation to anything which it may have done or not done in connection with these terms and conditions and the delivery of the Service (and whether the liability arises because of breach of contract, negligence or for any other reason) shall be limited to the Fees received by TX in connection with the relevant Online Course or Physical Course in relation to which a dispute has arisen.

No claim whatsoever may be brought more than seven (7) days after the last date on which the Services concerned have finished or ceased to be provided by us.
3. Intellectual Property

All Intellectual Property Rights in the Confidential Information, Course Materials, Online Courses and the speeches made by trainers at the Physical Courses are, and remain, the intellectual property of TX or its licensors, whether adapted, written for or customised for you or not.

You are strictly not authorised to:
-
copy, modify, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit or distribute any of the Course Materials without prior written consent from TX; and

record on video or audio tape, relay by videophone or other means the Online Course or Physical Course given;

Without prejudice to TX’s rights and remedies under these terms and conditions and under the law, any breach by you of this clause shall allow us to immediately terminate these terms and conditions with you and cease to provide you with any Services.

4. Entire Agreement
These terms and conditions set out the entire agreement and understanding between the parties in respect of the subject matter hereof and supersedes all prior negotiation, understandings and discussions, whether oral or written, of the parties and there are no representations, warranties, covenants, undertakings or other agreements, whether express or implied and oral or written, between the parties in connection with the subject matter hereof except as expressly stated in this Agreement.

5. Governing Law and Jurisdiction
These terms and conditions shall be governed by and construed in accordance with the laws of Malaysia. The parties irrevocably submit to the exclusive jurisdiction of the courts of Malaysia.
